Ok, I just posted quick story in 'deadbeat parents' about how this Beaver County of W.Pa works and here is what I am dealing with now. I hope some information is helpfull to others.
Important estate plan infomation... if elderly or have elders.. put your estate into a trust..... that is the only way you can keep peoples hands out of your pockets later.. If elders should end up in nursing home, all bank accounts, etc etc will end up wiped out by nursing homes...any money owed after this is used will be lean on property...you will here in pa, have 5 years to get things in your name before they go into a home or they can still attatch property......unless it is in a 'trust' older owners still can sell, do what want but moves down line when one passes...state not take or attatch..most elderly scared to do such with property. Now, also DONT think medicare is enough insurance... here in pa it only covers 20 days in home...after that..you are on own..make sure get some sort of insurance like Blue x shield etc prior to home..What happened here is this:... Elders had strokes and went to home meanwhile the wife died and he still in home..Medicare quit paying after his 20 days..so figure state welfare medical kick in..(was told that at homeat time he admitted)..but the lady that took care of paperwork in state welfare department was off sick and on vacation for a month and I was told have to wait her come back and not worry about the 'stack' of medical bills getting...said will be retro....so ok...finally the lady got back to work in beaver county welfare office (wife and I apply for her parents)..WWII purple heart vet and was told this....I have to write check for $7,000 to cover the month he lacked insurance before lady at state office ok the take over of state welfare medical for the 84 yr old vet. I pay for welfare?..Thought already did with my taxes?...Now I get phone call from 26 yr old punk with no job that pumping out kids (5) like rats bragging about all the welfare funding he gets and all the programs free..and I am to keep my cool?... I have to sell off a stock to pay for the 7g but now with the economy like it turned, I lost a grand on the stock.(state lady found out about stock owned)..said I could get the money from that...I hard time convince state lady benefits not for us.(we not responsable for his bills but they add up against his property unless have medical coverage)...we just doing leg work...they said is our parents and found out we have the stock and said we could sell it to pay nursing home.. so hands are tied and what I am against..guess have to do it in order to get medical coverage......I figure the 7g is to pay for some of the rest of deadbeats bills...state way to get some cash back into system..????? opinions?.....sorry about rant but there are some smart people in HC....and it is hard to keep cool dealing with all this crookedness...unfair.??. oh ...guess what, our state rep Veon had been ousted for stealing thousands and thousands from us while in office....maybe that is where the money is going?...pay for some state agency to steal????...ok, keep cool...don't worry about it/??

oh, forgot ...did talk to a lawyer about this...he just said...pay him a few grand and he not sure can do anything about it cause the nursing homes are protected from everything and everybody..but still pay him...everyone has hands out...just like the pre-paid funeral...for those that have this option taken care of...you better find out if the opening of ground, vault etc is covered....I found out it isn't..unless funeral home owns the cemetary....cost another grand on top of the pre-paid funeral...and I just made the last payment for my brothers funeral this month...now have pay another ....geez.....anyone have any lottery winnings need someone to spend for you?...figure you better save your money.....I might need it.

more proof that my dc theory is correct.
we are merely dairy cattle for the government...they milk us til they can't milk us no more then they pawn us off for burger or bait... :mad:

What you are talking about is Medicaid planning I believe. The Medicaid look back period used to be 3 years, but it was changed to 5 years to prevent people from gifting too much away before they went into a nursing home. The easiest way around this problem is to purchase long term care insurance at a young age. The statistics state that 50% of Americans will end up staying in a nursing home at some point, so the insurance coverage will take care of everything and you do not have to worry about spending down assets before Medicaid will cover the cost. The other way to deal with this issue is to be filthy rich so that your assets earn enough to pay for your nursing home stay.

As far as I am concerned, I complelety support this law. Why should taxpayer money be used to pay for somebody's nursing home stay if they have their own money. It would be like giving welfare handouts to people that don't need the money.

As far as the trust issue is concerned, you would have to put your assets in an irrevocable trust 5 years before entering a nursing home to get around this issue. Since the trust is irrevocable, you give up all rights to those assets once you put them in the trust. In fact, it is the same thing as gifting the assets to somebody. So, you had better trust whomever you are giving them to, because that person will have to take care of you for 5 years, and maybe more if you don't need nursing home care after 5 years of gifting the assets away.

This is a very touchy subject for a lot of people. My grandmother didn't want to give her money away no how, no way, so we used the money to pay for her nursing home care, and just figured it would be gone and nobody would get anything. She passed away after being in the nursing home for 3 or 4 years and there was some money left over, but I would have preferred it to be the other way around.

A lot of people seek attorneys to help them with this process, and then balk when the attorney tells them he needs $5,000+ as a retainer to help them. People have no idea how much work goes into Medicaid planning, or estate planning for that matter.

All I know is my blood ran cold reading that story.....Insurance of any kind use to be the stop-gate for catastrophes....I am waiting to hear how they will crash and burn when the hedge funders pull out...

we might be rethinking everything we know financially.......
