Obama to Seek New Assault Weapons Ban
Previous Ban Expired in 2004 During the Bush Administration

The Obama administration will seek to reinstate the assault weapons ban that expired in 2004 during the Bush administration, Attorney General Eric Holder said today.

Wednesday Attorney General Eric Holder said that the Obama administration will seek to reinstitute the assault weapons ban which expired in 2004 during the Bush administration.
(AP Photos/ABC News Graphic )"As President Obama indicated during the campaign, there are just a few gun-related changes that we would like to make, and among them would be to reinstitute the ban on the sale of assault weapons," Holder told reporters.

Holder said that putting the ban back in place would not only be a positive move by the United States, it would help cut down on the flow of guns going across the border into Mexico, which is struggling with heavy violence among drug cartels along the border.

"I think that will have a positive impact in Mexico, at a minimum." Holder said at a news conference on the arrest of more than 700 people in a drug enforcement crackdown on Mexican drug cartels operating in the U.S.

Mexican government officials have complained that the availability of sophisticated guns from the United States have emboldened drug traffickers to fight over access routes into the U.S.

A State Department travel warning issued Feb. 20, 2009, reflected government concerns about the violence.

"Some recent Mexican army and police confrontations with drug cartels have resembled small-unit combat, with cartels employing automatic weapons and grenades," the warning said. "Large firefights have taken place in many towns and cities across Mexico, but most recently in northern Mexico, including Tijuana, Chihuahua City and Ciudad Juarez."

At the news conference today, Holder described his discussions with his Mexican counterpart about the recent spike in violence.

"I met yesterday with Attorney General Medina Mora of Mexico, and we discussed the unprecedented levels of violence his country is facing because of their enforcement efforts," he said.

Holder declined to offer any time frame for the reimplementation of the assault weapons ban, however.

"It's something, as I said, that the president talked about during the campaign," he said. "There are obviously a number of things that are -- that have been taking up a substantial amount of his time, and so, I'm not sure exactly what the sequencing will be."

Explain how voting for Obama is going to help you insure no one does what the new AG says they are going to do to us. Guys,

The Clinton "Assault Weapon Ban" never affected more tha 4% of the guns used in crime and the crime rate did not go down because of the ban. The ban "Sunset" in 2004 and crime did NOT go up. To have Obama reinstitute the Assault Weapon ban is merely an indication of his anti-gun stance.

At the gun shop in town today, a dozen over age 60 folks discussed this subject. Al said, "When they come for my semi-autos, I will damn sure GIVE them the ammo first!" Nuff said.

No doubt, mine is a minority opinion, but what the heck....

In the Heller decision, Scalia finds that one of the purposes of the Second Amendment is to allow people to defend themselves, and that the guns people commonly own for that purpose have 2A protection. He then reasons that handguns are an example of firearms that people commonly choose for that purpose. They are, therefore, afforded 2A protection.

The exact same reasoning applies to black rifles that are not fully automatic.

I have no doubt that a new AWB would be found unconstitutional by the Supreme Court. We might have some hard years before the case works its way through, but I feel confident that it would and that we would prevail.

I have serious doubts that such a law will be passed. Too many legislators have found themselves unemployed as a result of supporting gun control. Especially in the House, where they face re-election every 2 years, there isn't going be any enthusiasm for a new AWB.

The thing we really have to worry about is the other approach to gun control. That would start with the US agreeing to the jurisdiction of the International Court, something we have never done. Once that is done, someone could bring a contrived suit in that court claiming damages as a result of US gun law. We would surely lose that. And just like that, we would be subject to UN rule on firearms without any action be our elected representatives.

Will the Supreme Court overturn Heller? No. Not even if the court were packed with the worst gun controllers in the country. The legal doctrine of stare decisis says that Supreme Court decisions are only overturned if they are glaringly wrong. SCOTUS will not re-open Heller. It is a brilliantly reasoned and well researched opinion that will stand.

Soo.... am I happy about the present situation. Not at all. As we all knew, Barry is a lying scum bag with no agenda but personal glory and power. Our situation is worse than it was. But without Heller it would be dire. It is hard to overstate the importance of Gura's victory there.

Unless you've forgotten, the President chooses who he wants on the court.....and we currently have one who will probably not be with us much longer (Ginsberg). Seeing as how he has placed rabidly antigun individuals in key positions, do you really think that he is going to nominate someone that will defend Heller? Esp. since the Democrats have control of both the house and Senate?:( Especially with Pelosi making statements such as "We are in control; we'll do what we want"?

Alot can happen in the meantime....anyone besides me here see any parallel between the current situation in the U.S. and Germany in the 30's? 16 Gauge, the situation with the Supreme Court is not as you imagine.

Yes, Obama will probably fill at least two vacancies on the Supreme Court. He will undoubtedly choose the most liberal Justices that he can.

But it will not make any difference in Heller.

Stare decisis is the legal doctrine that governs here. Basically, it says that once a matter is settled by the Supreme Court it will not be revisited except under the most extreme circumstances. Long after Scalia is gone, the 2A doctrines he articulated will remain and will be binding upon future members of the court. All future decisions on this topic will be guided by and subject to Heller. No Justices, however liberal, will be willing to re-open Heller because it would violate this almost sacrosanct rule.

The beauty of Heller is that is VASTLY more difficult to undo than simple legislation would be. Several Justices have opined that Roe v. Wade created bad law and precedent. But have they re-opened it? Not a chance. Same for Heller. They may hate it, but they won't overturn it. It's "settled law".

The bizarre thing that is going on is that we now have considerable LIBERAL support in our efforts to get incorporation of 2A against the states.

Back in the late 1800s, SCOTUS essentially gutted the Privileges and Immunities Clause of the 14th Amendment in the Slaughterhouse Decision. That's the one that says that states cannot abridge the privileges and immunities guaranteed by the Constitution. All incorporations since Slaughterhouse have come under the due process clause. The lib support we are getting is an effort to overturn Slaughterhouse (exceedingly hard to do). Our arguments are following the traditional path of arguing under due process, but if the liberals can use Heller to re-establish privileges and immunities, it would be even bigger than winning Heller.

No, I'm not happy about the news out of Washington. And I don't think our situation is that great. But it is also not so dire as some people would have you believe. The Supreme Court is designed to outlive and outlast the other branches of government, and to be the nearly immovable object that prevents fast, radical change.

Absent Heller, I'd be selling off firearms while it is still legal and the market is hot. As it is, I'm putting money and effort behind the NRA and figuring that the next few years will be stormy but not devastating. For at least the past decade, the tide was clearly running in our favor. Today, it is mixed.

Obama is in the process of demonstrating how you go about alienating your base, one faction at a time. My prediction is that if he keeps going the way he is, he will not even be re-nominated in 2012, much less re-elected. Key media support has already visibly eroded.

Not so. Heller clearly defines that if it is not a full auto, and if it is a type of firearm that people commonly own and use for self-defense, it has 2A protection.

Again, not so. Case in point: The Second Amendment was absolutely dead as a door knocker in most of the US prior to Heller. Most people just didn't know about it. Most of the Circuit Courts in the US had ruled it a "collective right" or a "sophisticated collective right". All courts inferior to them were bound by those decisions. Heller was a great rebirth of personal freedom. If we get incorporation of Heller via the Privileges and Immunities Clause, it will be an even greater landmark in personal freedom.

This is not about 'what's best for the people'....this is about power, pure and simple, ......and keeping it!

A couple of nights ago, my wife and I were flipping back and forth between Letterman and Leno. One had Donald Trump soundly blasting Obama's economic plan, and the other had Ariana Huffington also soundly blasting him. If a Democrat president can't get support from Ariana Huffington, it's a little like the Pope being unable to get support from the Vatican web site. Both hosts were agreeing with their guests. Such a display would have been unthinkable a few weeks ago. No, key support is eroding quickly. CNN and MSNBC will keep up the party line for a long time, but others are becoming disaffected.

Have a little faith. We will lose some ground for a while. Work like heck to protect what you can.

Heck, Dick Morris is predicting that things will shortly be so bad that we will get a Republican Congress in 2010. Don't know if he's right, but he's a pretty perceptive guy. That result would not surprise me in the least.

When I posted, I hadn't seen this: Senate votes 62-36 to override DC gun laws, and much of the credit goes to... may I have the envelope please... Eric Holder's unwise public comments.

The ploy that worries me the most is one that does not involve any legislation whatever. That starts with the President agreeing to the jurisdiction of the International Court. Then, some cooperating entity could bring suit against the US for failing to observe the UN rules on small arms control. We would clearly lose that suit. UN rules then become the law of the land... except that I think an international treaty does trump domestic law, but not the Constitution.

Anyway, if they can carry that off it's extremely bad for us. It involves no legislation, and we have no recourse.

I suppose we could cut off UN funding, which wouldn't hurt my feelings...

As much as Republicans bad mouth Pelosi, I think she might be one of the few politicians that has a clue about the feelings of America. I received an e-mail once about her wanting to institute a flat tax, but that e-mail was dead wrong and after reviewing her stance on income taxes, I support it. I know, I'm probably going to get blown out of the water on this board for just saying support and Pelosi in the same sentence.

In the end, I hope that Pelosi is speaking truthfully and forcefully regarding this stupid assault weapons ban proposal. Maybe Obama's staff will see all the internet chatter caused by this statement, and he will back off from it. I like some of his ideas, and think he should focus on the ones all of America can agree on needing to be done. If he accomplishes those, then let him try to resolve the stickier issues.

I think we can all agree that education and health care need to be addressed, and I am not talking about socialist health care, but some type of reform. We have been dealing with our health plan administrator for 4 months now on $160 worth of charges erroneously pulled from our HRA money, and the problem is pretty simple. The provider billed us for the $160 when they should have only billed us $10 (i.e., it was Target clinic and my wife is an employee of Target clinic). Now, we have until the end of March to resolve this and spend the money somehow, because we are moving from the HRA to a Traditional plan and will lose it if we don't use it. I won't even get started about our FSA money and trying to get them to release that. I might as well be talking to the wall. About the only thing we have going for us is that I am an attorney and I am not scared to use small claims Court.

If you don't think obama is a meglomanic, look at the pictures of him in newpapers. There is usually a statute of Lincoln, or a picture of Washington, or something along that order in the background of the picture. You can see how he feels about himself and how the media is willing to portray him.

He uses a lot of language from Lincoln's speeches too. I'll give him some time before I pass judgment on him, 6 months, maybe a year, and then I will start to be hyper critical. Nothing like having started investing in my retirement in 1997, and having the stock market back to 1997 levels where my dollar cost averaging has actually returned a huge negative amount. Here is looking to the next 30 years.

I don't like his insane spending, and I hate bailing anybody out, especially the banks and the people that got mortgages they could not afford. If it wasn't for those two groups, everything would still be going along fine, house prices wouldn't have reached the stratosphere, the Big 3 wouldn't need a bailout because people would still be able to afford a car, etc. Of course, the bank bailout was Bush's great idea.

I have to disagree. They haven't been sitting on their asses and doing nothing.. They have been laying on their backs and breeding and making more welfare recipients..since the 60's! Depending on you and me to support them and theirs. Lets start giving drug and alcohol tests to all welfare recipients. ..Also to all food stamp recipients. If they have enough money to by likker or drugs then they do not NEED the free handouts. And now they want to make all the illegals citizens...to create more welfare recipients...Oh he!!. they are getting it anyway...Signed...Annoyed in Amerika

For 26 years I lived in Salem, NH and NH and Maine were my territory. I spent far too many hours at Kittery Trading Post and every gunshop from Kittery to Fort Kent.

Hate to break this to you Fabs..but they already took your money. Many times but just lately they passed a spending bill worth approx 800 Billion. Have read that there is 3.2 trillion in cash in the US..That means they just printed(or will) enough money to devalue your net worth by 25% and then your portion as you have already pointed out I believe is 5700 bucks. It was spent in your(and my) name without us even having a say about it. I know you are an attorney etc but if you aren't pi**ed off about that then you aren't ever gonna get that way. Giving money to private companies in essence makes the government partial owners of that company at the very least..As I have said..Not creeping socialism...bounding Marxism/communism. One day we also will be able to say..the government pretends to pay us..and we pretend to work. If we do not stop this very soon..we are lost for certain.

BTW rioting just won't cut it..too easy to quell that type of uprising.. You don't remember the Baltimore riots...I do as well as other cities

Do we Americans even have a say anymore in what our Gov does?....I have to hijack this post for only a moment with a note to Fabs..our 'law man'...as attorney and going to court Fabs, I just left a court room last week..I got nephew out of jail 3yrs ago when his dad died..to attend..I gave him all his dads (my brother) items like wallet..well as I just took over POA of my mothers things, (his grandmother he lived with for over 20 yrs) I find out from bank statements he was living pretty well on her money..Cash advances on her credit cards like 1500 bucks at a time, charges to beer joints, filling peoples cars with gas, nude bar lap dances..then there is the check writing to pay off his lawyer (from when I got out of jail) ..of $990....oh and using his dead dads ID card and walking in the credit union saying he was his dad..(use to be co on moms account).and cleaning our my mothers savings..well..I took him to court..all he had to do is pay one $95. charge back to one bank and if I want anything else returned, I have to file in each town they originated in...believe that?..know what a pia that would be for me?..ah..he walks..If I went into a bank, lied about ID, cleaned out an account other than mine, I would be in jail....but here it goes back to your dealing with insurance co etc etc...nobody gives a butt about things anymore..we almost have to do their jobs for them..their paperwork...while again, those that have nothing....and don't want anything and that live off the gov ..just continue to do so....while we are the only ones that care....ok back to the original post...just had to grump a little..about the 'system'

Barack Obama is against concealed handguns and concealed handgun license holders. I don't make this charge without evidence. Mr. Obama, in an interview with the Pittsburgh Tribune-Review, stated "I am not in favor of concealed weapons." and further stated "I think it creates a potential atmosphere where more innocent people could (get shot during) altercations."

How much money are you talking about? If it is a decent sum, go talk to an attorney that will be willing to take this on a contingency fee. Banks are usually responsible for knowing their account holders. So, if he withdrew money out of an account in person, the bank would be on the hook for that. With the ATM cards you are probably SOL.

Did you sue him civilly?

Right now, the silver lining in this cloud is that it appears his free ride is over. Hope he has a tough life in front of him for what he has done. You just have to love this type of excrement.
