No charge for Phelps for pot photo

(UPI) - The South Carolina sheriff who has been investigating Michael Phelps on possible marijuana charges said Monday he doesn't have enough evidence to prosecute.

Phelps, who has won 14 Olympic gold medals as a member of the U.S. team, apologized several weeks ago after a British tabloid published a photograph of him smoking marijuana at a University of South Carolina party in November. The winner of eight gold medals at the 2008 Games in Beijing said his "behavior … was regrettable and demonstrated bad judgment."

Richland County (S.C.) Sheriff Leon Lott said Monday he has investigated the matter and has concluded there is insufficient evidence to prosecute Phelps or anyone else who was present at the party.

"Michael Phelps and I agree that something positive needs to come from this incident and that is a message of not using drugs," Lott said.

"Michael Phelps is truly an American sports hero," Lott said. "I, along with the rest of America, cheered his victories and felt pride when he stood on the podium to receive his medals. Even with his star status he is still obligated to obey the laws of our state. He also human and can make a mistake."

USA Swimming reprimanded Phelps, withdrawing financial support and declaring him ineligible to compete for three months.

If he was just ol Willie Jones from downtown nowhere he would be spending some time in the lockup...even if they ended up not charging him. Sports hero?? Phooey. Drugger is a drugger. Course i'm just to the right of Ghengis Khan. My feeling is if ya catch a guy dealing drugs ya 'dobe wall him.hmmmm Maybe wayyyy to the right of ol Ghengis.

I have a couple of retired pro baseball players...one is in the mix right now in the Barry Bonds upcoming trial....I was in my operatory when I heard Fox mention (my guy) was going to testify against him...told my Doc I dont think "our guy knows this"... we spend alot of "after hours" with our guy...sure enough they had him all over the news and he didnt know a thing about it....we figure it was to put the heat on Bonds...but one does have to wonder?????
