79 year old man shot dead in home by Police

DAYTON | Jack W. Simpson of the Dayton police department's Fifth District was the officer involved in a Saturday night shooting that resulted in the death of a 79-year-old man, police said Monday.

Simpson, 40, is currently on administrative leave while the police department conducts its internal affairs investigation, police said.

Simpson shot Donald Schwartz after Schwartz fired at least three times and ignored several warnings to drop his six-shot revolver, police said.

One of Schwartz's neighbors, Jerry Johnson told a Dayton Daily News reporter that he called 911 Saturday to report that Schwartz was making threats and brandished a gun.

When Simpson arrived to 27 N. Lawn St. he asked Schwartz to put down his gun. When Schwartz refused, Simpson used the Taser on Schwartz, Dayton Police Director Julian Davis said.

Schwartz pulled the Taser electric-stun probes from his body and fired three shots at the officer, who retreated behind his squad car, Davis said.

Schwartz then ran inside his home, with the officer pursuing, and fired more shots, Davis said.

"The officer returned fire and neutralized him," Davis said.

Johnson and his fiancé Krista Brown said they called police numerous times about Schwartz. The couple, who are both black, said Schwartz, who is white, often lobbed racial slurs at Brown.

Goes to show the "big bad Taser" doesn't always work, it's no "magic bullet". Sounds like this fella had strong prejudices, and they got worse with Alzheimer's.
