Vang won't hang....

...but he will go to prison for life. His Sister claims that the trial was unfair "because the jury was all white!"

The trial was held in Sawyer County, a northern county full of lakes and woods. The jury was picked from Dane County which is the most liberal county in the state. I listened to some of his tetimony, he convicted himself. One point to make he was very open as he described what happened. Conflict in testimony was who shot first. He shot unarmed people to defend his honor, and he so stated this on the witness stand. Pretty hard not to convict him, he did most of it himself. Justice served not denied.

What honor is there in shooting unarmed people? How honorable is that?

This makes me sick. Even if the other armed people shot at him and he killed them, he should be fried, injected, beheaded, or whatever else for killing unarmed people.

Then the liberals wonder why cirme continues and their taxes are so high.

Maybe Val will disagree with me on this one and think the death penalty is not appropriate here.

Fabs, how would you like to be the defense attorney in this case and have your client on the stand describing how he was insulted and that he was being treated disrespectfully so he shot them. That would be a tough hole to crawl out of.

I followed the case from the start. It was a slam dunk and justice was served. I think the death penalty would be appropriate.

In his testimony he didn't say that he was fired on first. He said something like "I believe I heard a shot and I believe I may have saw dust fly in the dirt like a bullet went by".

I don't want to bring race into this, I don't think it's an issue. I don't want to defend Vang or even sound like it was in any way justifiable. But this might be a warning to everyone to be very careful when confronting any person with a firearm. Be careful, they just might snap. Even if you're completely right you'd still be just as dead.

Yesterday they had a hearing as to lesson the charges of murder to manslaughter for some illegal who beat her three year old to death....the ME was on the stand graphically relaying the damage done to the baby...the mother screamed and yelled that she would jump up and beat the ME to death....and ran into a side room that was next to the courtroom...they had the cameras on her and for five minutes all you could hear was her threats and obscentites coming from that room....judge decided to keep the murder charges......another Darwin Award....

I cringe whenever any of my clients have to take the stand and be cross examined. I also cringe every time the Judge asks a client of mine a question, whether it be on the stand or during sentencing. Luckily, I don't do too much criminal stuff.

As far as Vang is concerned, I never would have had him take the stand unless he and I had gone over his testimony 100 times and he knew exactly what he was supposed to say (i.e., he could state the answers to my questions without thinking too much). Now, please do not take this as me coaching my client as to what his testimony should be. When I initially interview a client, I ask them what happened. If they tell me they are guilty, there is no way they will be taking the stand. If they give me some alibi or some other description of the facts the exculpates them from the crime, then we got over those facts until they know them forward and back.

Also, keep in mind that the State's Attorney tries to put words into the defendant's mouth on several occassions. I had the State's Attorney try that on me while I was in law school. I was pissed, to say the least.

Any Attorney will try to put words in your mouth when you're on the stand, that's what they do.

If they've told you they're guilty...why not put them on the stand so they can hang themselves? At that point you've probably received enough money from them.

At the end of the day, it is up to the client whether or not he/she takes the stand. However, I cannot ask them a question that I know they will lie to, so it puts me in a tough spot if I know they did it. If they lie on the stand and I know they lied on the stand, I have to decline to represent them at that point, but I cannot do it in a manner that prejudices them. It is a very tough situation. Thankfully, I haven't known of any client lieing on the stand toa question that I asked.

If they are guilty, my advice to them is to stay seated the entire time exercising their 5th Amendment Right and attacking the State's case against them. If I were to let all my clients hand themselves, word of mouth wouldn't be too good regarding my defense skills. Hence, no word of mouth clients or repeat clients.

Thankfully, I don't do too much criminal stuff and for the most part, it seems as though justice has been served in every criminal case I have dealt with.
