wife got fire from wal-mart today

Well the title says most of it. In the last several months the Wal-mart in Crockett Texas has promoted at least half a dozen GED holders who have not been there as long as she has to higher positions than she is in. She had three years with the store and a bachelors degree. They fired her today because she couldn't come to work for two days and left early on another day due to her sinus infection. What makes this more of a joke is that fact that her meds (given to her by the Doctor when HE wrote her the note for work that she COULD NOT be there due to dizzyness and nausia) where turned into the pharmacy at the same wal-mart on Wednesday morning, the meds she needed to be able to go to work mind you, and the pharmacy didn't fill them until after she was fired this afternoon. It is walmart policy that illness, even contagious illness mind you, is not a valid reason to miss work EVER.

Sorry to hear it. Now, here is the thing.

I ain't no lawyer, but it sounds to me like you have a potential law suit. If she hasn't used all her sick days, then she is entitled to be off due to illness. Also, the fact that you had a doctors note AND the fact that the perscriptions were filled at that same Walmart, should be enough for you to file a complaint.
The passing of a person with a bachelors for promotion doesn't surprise me at all.....they can pay those GED people less money (the profits of which will go back to China, to make toys with lead paint, dog chews with poison in them, and heparin without heparin in it!)
I quit shopping there a few years ago when I realized what they were doing to this country.
Hope she finds a new (and better) job soon, and hope she's feeling better.

cousin works at optical dept in their Cranberry Pa store....has optical insurance but has to go to another store in order to use it...they don't even honor their own insurance they give to their employees... they aren't allowed to go over their hrs of work either..or get fired..on other hand, when they close his optical dept at 8pm, if someone comes in (and do) at 756 and want glasses, he has to stay over and take care of them...and I thought my new boss was bad..well..he was..and was reason I quit union job and moved on..only worked new job a yr then retired...mostly for med reasons...but it is bad everywhere..new boss at my wife's plant fired everyone that knew something about the place and has since run the plant to the ground..laid off 2 turns and 1/2 people from remain turn...yet expects those still there to do work of when plant was in good shape.. things happen for a reason...know she will find a better place in life...sucks..but things happen for a reason..maybe check into housing management??..an employment agency in your area for one of their office positions?..keep faith..be a + in the end.

I am sorry to hear about your wife. You might want to speak to an attorney, but do not get your hopes up and do not retain an attorney that is not willing to take the case on a pure contingency basis (i.e., not a penny comes from you). If an attorney is not willing to take this type of case on a pure contingency basis, then the attorney doesn't think it is a good case.

I have had several people come to me after they get fired/laid off to see what their legal avenues are. For the most part, when it is an employment at will agreement with no union contract and no employment contract, there aren't many avenues available. In an employment at will situation, the only recourse the employee has against the employer for being fired/laid off is if the employee was fired based upon one of the protected classes (e.g., age, sexual orientation, sex, religion, Americans w/ Disabilities Act, Family Medical Leave Act). That is not an exhaustive list, so see a labor attorney in your state and get his/her opinion on this matter.

Good luck and hopefully this works out for the better (i.e., your wife gets a better paying job with a better work environment).

Hate to hear it. I hear it`s getting harder to find a job and that make me glad I`m retired. I still think that any one that really wants to work can find a job though. I`ve got a neighbor that quites a job or gets fired about once a month and she never is off work over 3 days untill she starts her next job. I don`t know how she keeps finding them as she has worked every place within 50 mi. now.

Yep Texas is a right to work state and you are an at will employee in it.

Also bear in mind I mean what I said. They have NO sick days at the Texas wal-marts. If you don't come in you get canned. You can miss no more than 3 days for ANY reason in 6 months, and if those three days are together then forget it. They fact that she went home early one day because she was vomiting counted as day 3 for them. So there ya go.

Walmart's a joke anyway..... I wouldnt lower my standards of doing anything for that hole......YOUR WIFE CAN DO A LOT BETTER THAN WALMART !

Sorry to hear that, GOB. I've heard lots of similar stories about Chin- er uh, WAL Mart, though. She'll just find a better job in a better place.
